Terms of Service

1. Who we are

These terms are an agreement between you and Pretiosus, a sole proprietorship of Christy Robin, GSTIN 32BPCPV0220D1ZL, with its registered address at 3rd floor V970, bldg no 60/44, JC Chambers, Panampilly Nagar, Kochi, Kerala 682036, India ("Pretiosus", "we", "us"). Pretiosus is managed by Robin Rajan. You can reach us at office@pretiosus.cc or +91 79998 38411.

"You" means the person or business buying from or using Pretiosus. If you accept these terms on behalf of a business, you confirm that you are authorised to bind it.

2. What these terms cover

These terms apply to:

  • this website, www.pretiosus.cc;
  • our software subscriptions, Bridge (connectbridge.ai) and FirstTouch (firsttouch.si), together the "Products", including when you sign up through those websites; and
  • our AI and automation development work for clients (the "Services").

If a Product's website publishes additional terms for that Product, those apply as well. For Services, the written proposal or statement of work for a project also applies; if it conflicts with these terms, the proposal or statement of work governs for that project.

3. The Products

3.1 Bridge

Bridge (product name "Bridge AI") is a customer-messaging tool for WhatsApp and Instagram, for clinics and other small businesses. On WhatsApp, it receives, organises and displays the messages customers send to a business, and lets the business's authorised staff reply using scripted answers, ready-made templates and simple automations. On Instagram, it can send one automatic private reply to people who comment on the business's posts. Replies in Bridge are scripted, not generated by AI.

  • Bridge only lets a business reply to customers and patients who contacted it first.
  • Bridge is not a medical, telemedicine or prescription service. It does not give medical advice, diagnose or prescribe. A clinic using Bridge remains solely responsible for any clinical information it communicates.
  • Patients and customers never pay through Bridge. The business pays for its subscription.
  • The business connects its own WhatsApp Business Account and Instagram account, and must comply with the terms and policies that apply to those accounts.

3.2 FirstTouch

FirstTouch is an AI-assisted inbox for inbound B2B sales enquiries. It handles enquiries from people who have already contacted your business. It is not a cold outreach or telemarketing tool.

3.3 Third-party platforms and AI output

The Products depend in part on third-party platforms, such as the WhatsApp Business Platform, Instagram messaging, email providers and AI model providers, and their availability can affect ours. FirstTouch's AI-assisted output can be inaccurate or incomplete; you should review it before relying on it or sending it. Pretiosus is an independent business and is not affiliated with, endorsed by, or sponsored by Meta, WhatsApp or Instagram.

4. The Services

  • Before work starts we agree in writing the scope, deliverables, schedule, milestones and price of each project.
  • You agree to give us the information, access and feedback the project needs, on time. Delays on your side may move the schedule.
  • Changes to the agreed scope are agreed in writing and may change the price and schedule.
  • Work is delivered electronically as described in our Shipping & Delivery Policy.

5. Accounts

  • You must give accurate information and keep your sign-in details secure.
  • You are responsible for what your authorised users do in your account.
  • Tell us promptly at office@pretiosus.cc if you suspect unauthorised access.
  • You must have a lawful basis for the personal data you handle through the Products, including any consent required from the people who contact you.

6. Prices, payments and taxes

  • Current prices are shown on our pricing page. Prices for Services are confirmed in the written quote for each project.
  • Card payments may be processed by Stripe, Razorpay or Lemon Squeezy. When you pay, the payment provider handles your card details. We never receive or store full card numbers.
  • Product subscriptions are paid through a secure payment link that we send you: through Razorpay for prices in INR, and through Lemon Squeezy for prices in USD.
  • When you buy a Product subscription through Lemon Squeezy, Lemon Squeezy is the merchant of record and reseller for that purchase, and its buyer terms also apply. Lemon Squeezy is used for software subscriptions only.
  • Services are sold by quote and invoiced by Pretiosus directly, for payment by bank transfer or PayPal. Services are never sold through Lemon Squeezy.
  • Prices are shown before tax. For prices in INR, GST at the applicable rate is added at checkout. For prices in USD, any applicable taxes are added at checkout; where Lemon Squeezy is the merchant of record, it calculates and collects them. You are responsible for any other duties or bank charges that apply to you.
  • If a payment fails or is reversed, we may suspend access to the Product until it is resolved.

7. Subscriptions, renewals and cancellation

  • Subscriptions are billed monthly, in advance, and continue from month to month until cancelled. Depending on how you pay, each renewal is charged automatically or paid through a new payment link that we send you.
  • New customers can start with a 14-day free trial, as described on the pricing page. No card is needed for the trial, and nothing is charged unless you choose to continue on a paid plan.
  • Plans that include unlimited conversations are subject to fair use: normal messaging between your business and the people who contact it. If use is excessive or abusive, we may contact you to agree a suitable plan, or limit it.
  • You can cancel at any time by following the steps in our Refund & Cancellation Policy, or by emailing office@pretiosus.cc. When you cancel, access continues to the end of the month you have paid for and the subscription does not renew.
  • When refunds apply, and how to request one, is set out in our Refund & Cancellation Policy.
  • If we change the price of a subscription, we will tell you by email before the change applies to your next renewal, so that you can cancel first if you wish.

8. Acceptable use

The Products are for replying to people who contacted your business first. You must use them only for that purpose and in compliance with applicable law. You must not use any Product or Service:

  • for cold outreach or telemarketing, meaning contacting people who have not previously contacted, or consented to be contacted by, your business;
  • for bulk or unsolicited messaging, including sending unsolicited messages to lists of recipients, broadcasting promotional content to people who have not consented, or any comparable mass-messaging activity;
  • with unlawfully obtained contact data, such as purchased, rented or scraped lists;
  • to provide telemedicine, prescriptions or medical advice through Bridge, or to collect payments from patients through Bridge;
  • for any unlawful purpose, including fraud, harassment, impersonation, distributing malware or infringing intellectual property;
  • to break or get around security or limits, including accessing other customers' data, testing our security without permission, or interfering with normal operation; or
  • to resell the Products or make them available outside your own business without our written agreement.

We may suspend or end access if we reasonably believe these terms have been broken, if continued use creates a security or legal risk, or if a law or the operator of a connected third-party platform requires it. Where practical we will give notice and a chance to fix the problem first.

9. Your data

You own the data that you and your customers submit through the Products. We process it to provide the Products, on your instructions, as described in our Privacy Policy. You can ask us to delete it through the data request page.

10. Intellectual property

  • We own the Products, this website and our pre-existing tools, code and know-how. While your subscription is active and paid, you have a limited, non-exclusive, non-transferable right to use the Products for your own business.
  • For Services, once you have paid in full for a project, you own the deliverables created specifically for you in that project, unless the proposal says otherwise. Where a deliverable includes our pre-existing tools or code, or third-party or open-source components, you receive a licence to use them as part of the deliverable, under their own licence terms where applicable.
  • If you send us feedback, we may use it to improve our Products without obligation to you.

11. Availability and support

We aim to keep the Products available and working correctly, but we do not guarantee uninterrupted availability unless a separate written service level agreement says so. Maintenance, third-party platforms and events outside our control can affect availability. Support hours and response times are shown on our contact page.

12. Disclaimers

Except as expressly stated in these terms, and to the fullest extent permitted by law, the Products and Services are provided "as is" and "as available", without any other warranty, express or implied, including fitness for a particular purpose. We do not warrant that the Products will be error-free or that every message will be delivered, because delivery depends on third-party systems.

13. Limitation of liability

To the fullest extent permitted by law, Pretiosus is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, business opportunity or data, arising from these terms or from use of, or inability to use, the Products or Services.

To the fullest extent permitted by law, our total liability arising from these terms is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law, including liability for fraud.

14. Indemnity

You agree to compensate Pretiosus for claims, losses and reasonable costs arising from your breach of these terms, your unlawful use of the Products, or your handling of personal data in breach of applicable law.

15. Ending the agreement

You can stop using the Products and cancel your subscription at any time. We may end the agreement as described in section 8, or on 30 days' written notice for any other reason. When the agreement ends, your access to the Products ends and your data is handled as described in our Privacy Policy. Terms that by their nature should survive will survive.

16. Changes to these terms

We may update these terms. If a change materially affects your rights, we will tell you by email before it takes effect. The date at the top of this page shows when the terms were last changed.

17. Governing law and courts

These terms are governed by the laws of India. The courts at Kochi, Kerala, India have jurisdiction over any dispute arising from or in connection with these terms, subject to any rights you have under applicable law to bring proceedings elsewhere. Before going to court, please contact us so we can try to resolve the issue.
